If following consultation with MTO and BTE, you have serious unresolved concerns with the project, you have the right to make a written request to the Minister of the Environment, Conservation and Parks for a Section 16 Order under the revised Environmental Assessment Act.

A request to the Minister of the Environment, Conservation and Parks for a Section 16(3) Order for the imposing of additional conditions or a Section 16(1) Order requiring an individual environmental assessment may be made on the grounds that the requested order may prevent, mitigate, or remedy adverse impacts on constitutionally protected Aboriginal and treaty rights. Requests should include your full name and contact information.

Requests should specify what kind of order is being requested, (additional conditions or an individual environmental assessment), explain how an order may prevent, mitigate or remedy potential adverse impacts, and can include any supporting information.

A Section 16 Order request must be made during the 30-day review period. If there are no outstanding concerns after September 11, 2024, the project will be considered to have met the preliminary design Environmental Clearance requirements of the Class EA (2000) and the project can proceed to the detail design stage of rehabilitations and replacements. The request must be sent to each of the following:
